MOCAP CENTRAL EULA

This Mocap Central Content End User License Agreement (“Agreement”) is a legal agreement between you (either an individual or an entity) and Mocap Central LLC and governs your use of the digital assets (“Content”) provided. By purchasing Content or creating an account, you agree to be bound by these terms.

1. GRANT OF LICENSE

The Vendor grants to you a Royalty-Free, non-exclusive, worldwide, non-transferable commercial license to use the Content. This license is granted to a single user or entity upon purchase.

  • Imagery & Linear Media: Use Content in film, television, movies, social media, and advertising.
  • Interactive Use: Incorporate Content into games, AR/VR projects, and virtual worlds.
  • Physical Form: 2D-printed packaging or promotional materials are permitted. Any three-dimensional art (3D-printing) derived from Content is permitted for personal use only.
  • Client Work: You may use Content in projects created for a client, provided the Content is embedded and not accessible as a standalone file to the end client.

2. RESTRICTIONS

  • No Standalone Redistribution: You may NOT sell, rent, or redistribute the Content on a "stand-alone" basis or as part of a stock library, 3D marketplace, or character creator tool.
  • No Competition: You may NOT use the Content to develop a product that competes with Mocap Central.
  • No AI Training: You may NOT use the Content in datasets for the development or training of Generative AI Programs, machine learning, or deep learning models.
  • Extraction Prevention: You must use industry-standard measures to ensure Content is contained within proprietary formats so it cannot be easily extracted by end users.

3. EDITORIAL USE ONLY

Content marked "Editorial Use Only" may only be used for news, blogs, or non-commercial documentaries. It may not be used for any commercial product, logo, or advertisement.

4. LIMITATION OF LIABILITY & WARRANTY

Content is provided "AS IS." Mocap Central disclaims all warranties of merchantability or fitness for a particular purpose. In no event shall Mocap Central be liable for loss of profits or indirect damages. Liability shall not exceed the total amount paid for the Content.

5. GOVERNING LAW

The laws of the State of Utah govern this Agreement. Any disputes shall be settled in the courts of Utah.
